1. Agreement

Welcome to ShareViral ("ShareViral," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our websites, applications, APIs, and related services (collectively, the "Services"), including content and features available through shareviral.co and related domains.

By creating an account, clicking an acceptance control where offered, or otherwise accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

You are responsible for your account credentials and for activity under your account. Keep your information accurate and notify us at help@shareviral.co if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, create risk, or as required by law or third-party platform policies.

3. Services and third-party platforms

ShareViral may provide tools such as connecting social accounts, creating and scheduling content, uploads, analytics, billing, and integrations with third parties. Features may change; we do not guarantee uninterrupted or error-free operation.

The Services may let you connect third-party social accounts—for example through a Connect Accounts or similar flow—including Facebook (and related Meta/Instagram features where available), LinkedIn, TikTok, and X (formerly Twitter). When you connect an account, you authorize ShareViral to interact with that platform only as needed to provide the features you use (such as displaying linked profiles in your account and publishing or scheduling content when you instruct us to).

Each platform has its own terms, community rules, developer policies, and privacy policy. You agree to comply with those platform rules when using integrations. If a platform suspends your account, changes its APIs, revokes tokens, or limits our app, we are not responsible for that platform's actions or for any resulting loss of functionality.

You may disconnect linked accounts where the product provides controls, and you may also revoke ShareViral's access from the platform's own settings. Disconnecting may limit or disable features that depend on that connection.

The Services may also depend on other third parties (for example, Google sign-in, payment processors, hosting, or AI providers). Those services have their own terms and policies. We are not responsible for third-party availability, API changes, enforcement, or account restrictions beyond what these Terms expressly state.

4. Your content

You may submit materials such as text, images, videos, and links ("User Content"). You grant ShareViral a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and distribute User Content only as reasonably necessary to provide, secure, improve, and support the Services.

You are responsible for User Content and represent that you have the rights needed to use and publish it. We may remove or restrict content or accounts where we reasonably believe there is a violation of these Terms or applicable law.

5. Acceptable use

You agree not to:

• Violate law or infringe others' intellectual property, privacy, or publicity rights.
• Harass, threaten, defame, or harm others; promote illegal activity or violence.
• Distribute malware, interfere with the Services, or attempt unauthorized access.
• Misrepresent identity, manipulate metrics, send spam, or violate platform policies.
• Use connected social platforms (including Facebook, LinkedIn, TikTok, or X) in a way that violates those platforms' terms, spam or automation rules, branded content rules, or other policies.
• Reverse engineer or circumvent security except where applicable law permits.

6. Intellectual property and feedback

The Services, including software, branding, and our materials (excluding your User Content), are owned by ShareViral and its licensors. Except for rights expressly granted here, we reserve all rights.

If you provide feedback or suggestions, you grant us permission to use them without obligation to you.

7. Paid plans and billing

Paid features are subject to the pricing and terms shown at purchase or in your account. Payments may be processed by third parties; their terms may also apply. Unless required otherwise by law or stated at purchase, fees may be non-refundable and subscriptions may renew until canceled. You are responsible for applicable taxes.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHAREVIRAL AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM THESE TERMS OR THE SERVICES. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO SHAREVIRAL FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU HAVE NOT PAID US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

10. Indemnity

You will defend and indemnify ShareViral and its affiliates against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Services, your violation of these Terms or law, or your violation of third-party rights or platform policies.

11. Termination and changes

You may stop using the Services at any time. We may suspend or terminate access for violations, risk, discontinuation of the Services, or other legitimate reasons, with notice where reasonable. Provisions that should survive termination (including ownership, disclaimers, limitations, indemnity, and governing law) survive.

We may modify these Terms by posting an updated version. Material changes may include additional notice where appropriate. Continued use after the effective date constitutes acceptance.

12. Export, governing law, and disputes

You represent that you are not prohibited from using the Services under applicable export control or sanctions laws.

These Terms are governed by the laws of the jurisdiction where ShareViral's operating entity is incorporated, without regard to conflict-of-law principles, unless mandatory local law requires otherwise. Unless prohibited by law, courts in that jurisdiction have exclusive venue for disputes arising from these Terms or the Services.

13. Miscellaneous

These Terms, together with policies they reference (including the Privacy Policy), are the entire agreement for the subject matter. If a provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
